THE FORECLOSURE
PROCESS


Every state has a specific foreclosure process that must be followed. Regardless of what anyone tells you, the law must be followed completely by your lender in order for them to foreclose on your property, and this depends on your particular state law. You should look up the foreclosure law in your state1 so that you can find out what your timeline is and what your rights are. You also need to be informed as to where in the timeline you currently are and how much time you have to work on saving your home. I have seen a lot of scared people move out the first month they are late on a payment because they fear being evicted by the sheriff. There are foreclosure laws, and then there are eviction laws. BOTH MUST BE FOLLOWED BEFORE ANYONE CAN EVICT YOU. Check with your local superior court for eviction information.

Where you are in the foreclosure process determines the amount of time you can use as a guide during the processing of your loan modification. Even if you are denied a modification, even more than once, if you are able to change your circumstances, raise your income (i.e., a new job, second job, renting a room, find someone willing to contribute to your household, such as a relative or friend), or reducing your expenses (lowering your insurance, auto, home, property taxes—selling your car, or finding someone who will take over any of your payments), then you can start the process again. Call the lender; tell them that your financials have changed and that you want to resubmit the request for modification. THEY DON’T KNOW THIS IS WHAT YOU WANT TO DO UNLESS YOU TELL THEM.

Do not be afraid to ASK questions. Remember: THIS IS YOUR HOME you are trying to save; and frankly, it is more important to you than anyone else, so give it your all.

Remind them over and over that you intend on keeping your home and that you want to work with them to find a program that is an acceptable fit.

Also, if you are denied, don’t be afraid to call the lender and ask them why. Get specifics, such as dates and the income and expenses that were used. Compare their numbers to the numbers you already submitted to them.

Keep in mind, humans and computers both make mistakes. Oftentimes, they are using the wrong numbers and this causes you to be denied a modification; it doesn’t help if you just accept it and never find out WHY.

Foreclosure: It Can Happen to
Anyone?

It was once believed that foreclosure was only for all of those people who bought homes they couldn’t afford. No longer is that the case, and I am here to bust that myth. People do not have to hide behind the embarrassment and shame of foreclosure because there are approximately 6 million American homeowners with some sort of a default, ranging from 30-plus days delinquent all the way to a full-blown foreclosure. Homeowners have a lot of company these days when facing this housing crisis, a lot of company, indeed. It is not limited to people of lower income, occupation, and social status. Unemployment is at its highest, countless numbers of people are already off the unemployment insurance grid but are still unemployed, and the census numbers are reporting that one in seven Americans are at poverty level.

You could be the Octomom, or an Orange County housewife reality TV star living in a multi-million dollar mansion, or even the late Ed McMahon of high celebrity status. It could be your sister, your brother, your best friend, or your aging mother. It might be your neighbor, your boss, your employee, or your customers. Heck, it could even be YOU.

Even when it is not currently you, one credit line less for the company you work for and a downsizing could happen and you might be out of a job tomorrow. That is the reality of the situation and the reality of what is happening. I am not one to be negative, but I think it is important to have empathy for our fellow man because foreclosure is devastating to families, neighborhoods, cities, and states. It affects so much more and carries a ripple effect, so many ripples, in fact, that there are too many to mention. What I can mention is that regardless of whether or not you ever have to personally face foreclosure in some roundabout way, it most certainly does affect you. That’s why I urge you to do what you can to let your congressman know that the American people need help, real help. They need to cut the red tape associated with the current programs, and they need accountability, especially since we are all footing the bill.

It is important for you to know that many people facing foreclosure today actually were able to afford the homes that they bought at the time they bought them. You should consider this before believing that foreclosure is only for those people that could not afford to buy these homes, or that they deserved those bad loans due to a bad credit profile. Most of them even had reserves in the bank that are now gone, as also is the equity they thought they had, too. Please don’t try to take their dignity away, too, while they live in fear of not only being unemployed, but of being homeless, as well.

I urge people facing foreclosure to know their numbers, empower themselves with real knowledge, believe they will prevail, verify everything, follow up, and take action to make what you want happen. To think for yourself, you MUST question authority.

Mentality: How to Properly Escalate
Your Issues
Don't Guess, Know Your Stuff

When you are experiencing problems in the processing of your file and are not able to get resolution, it is first important for you to have a clear understanding of where you stand before escalating to the next level. It is not a good idea to escalate your file until you are sure you fit within guidelines of the program you are applying for because the last thing you want to do is escalate a file that does not qualify and get rushed through the foreclosure cycle because of it.

Once you are sure that you fit within the guidelines and you have unresolved issues or you cannot get someone to discuss and help you resolve them, then it is time to escalate to the next level. You can do this on the phone, but I prefer doing this in writing to the correspondence address on your mortgage statement.

If you still get nowhere, then keep going up the chain of command by doing research on the company and its key players. New escalation processes have been put in place by government officials and Treasury executives as a result of the Dodd-Frank Act.

In your escalations, include:

A full copy of the file you have submitted along with a detailed, but not too long, cover letter specifying the issues you are experiencing (see letter examples in reference section).

Keep a conversation log, noting every single person you have spoken to, including your servicer, lender, or government officials. Make sure to gather and document this information:

  the employee’s first and last name,

  department,

  identification/employee number,

  always note the date and time of the call and the number you dialed (See Conversation Log in Chapter Five)

  Be sure to summarize what was discussed, including any steps you were asked to take, or any missing documentation, fax number, mailing address, or email address (preferred). Save all fax confirmation sheets and follow up with a letter.

Call daily and keep these notes for all communications in any form (written, verbal, email, fax, etc.) Save all fax confirmation pages.

I recommend also sending correspondence return receipt requested as much as possible to cover your tracks! Even write letters covering your conversations, such as the one below.

Dear Bank,

On May 21, 2011 at 12:23pm I spoke to Jane Doe and she advised me that the June 1st trustee sale date was put on hold. Please include this confirmation in my file.

Sincerely,

Mr. Homeowner

Being Resourceful and Doing
Research to Resolve Issues

This type of escalation is only necessary and suggested after first exhausting all other avenues. Build your case, but if you are in jeopardy of losing your home sooner rather than later, then do not hold back from contacting whomever you have to in order to save your home. But I warn you, know your numbers and be knowledgeable about your entire file first!! Many people fight for files that are impossible to approve for a loan modification; don’t let this be you.

Google, Yahoo, Bing, You Tube, and all search engines are your friends. Look through the lender’s website for as much information on them. Scour the Internet when searching for:

Executive office addresses, phone and fax numbers to direct your escalation letters:

Vice Presidents, Presidents, and CEO’s.

Board Members, if necessary, for blatant escalation.

Government Officials: Congressman, Senator, Governor, FDIC, Treasury, HUD, FHA, Fannie Mae, Freddie Mac.
