This volume presents a comparative analysis of the many jurisdictions currently in the process of introducing a system of deposit protection or considering amendments to their existing framework.
A number of international high profile banking scandals in the latter half of the 20th Century has demonstrated the need for the protection of bank depositors in both developed and developing countries. The severe crisis in the US in the late 1980s and early 90s provided an example of the use of a deposit insurance scheme in a developed country. This volume presents a comparative analysis of the many jurisdictions currently in the process of introducing a system of deposit protection or considering amendments to the existing framework. Key features: * Uniquely, provides a legal rather than purely economic perspective on the issue of depositor protection; * Presents an international, comparative approach; * Offers an analysis of policy issues in both developed and developing countries; * Examines the history of international efforts to protect depositors with particular emphasis on the introduction of deposit insurance in the US and EU; * Discusses the role of international bodies such as the IMF and the World Bank. `Protecting Bank Depositors and the Banking System: The Legal Perspective' will provide an invaluable resource for students and academics of banking and financial services law. It will also provide a useful reference for bankers, legal practitioners, policymakers and officials of international financial organizations.
