Describes and analyzes case law arising from professional negligence and, using case studies, shows how claims have arisen - indicating practical implications rather than legal principals.
This book seeks to explain, with examples from cases, the professional responsibilities and liabilities of practising architects. As well as chapters on the bases of the legal obligations and professional relationships and roles, it takes each of the work stages in the RIBA/RIAS Conditions of Appointment (standard form of agreement for appointment of an architect) and analyses the potential liability resulting from that aspect of the architect's work from pre-design work, through design and contract administration. It highlights issues of current concern such as collateral warranties, the CDM Regulations introduced late 1994 / early 1995 and post-construction liability (given increased importance under the Latham Report proposals). It includes the RIBA/RIAS standard form and British Property Federation Collateral Warranties in the appendices.
