The book provides students with a comprehensive overview of the conflict of laws rules as they apply in English law. The preliminary topics of the bases of conflict of laws, classification, connecting factors, renvoi and public policy are scrutinised in the first part, followed by consideration of the rules ascribing jurisdiction both under the common law and the Brussels and Lugano Conventions. The book then covers fully the recognition and enforcement of foreign judgements and explores the choice of law rules in respect of contract, tort, movable and immovable property and succession. In the final part, the traditional concept of domicile, and family lawmatters, such as marriage, dissolution and matrimonial causes, are examined. Since the second edition, a number of important changes have taken place in this ever developing field of law. This edition takes account of recent changes and is presented in a reader friendly manner, facilitating understanding of this notoriously difficult area of law. The question of jurisdiction under the traditional common law rules is examined in depth and the rules set out in the Brussels and Lugano Conventions are analysed.
The changes brought about by the Family Law Act 1996 are also included and, for ease of reference, the most important statutory materials.
Abla Mayss, PhD, LLM, Licence en Droit, is Lecturer in Law at the Faculty of Law, University of Liverpool. She has many years' teaching experience in conflict of laws and has written extensively on the subject. She has examined conflicts of laws for the Bar Council and has lectured at the Faculty of Law, University of Manchester, and the Law School, Staffordshire University.
