This text examines and explains the conditions necessary for the protection of identifiable intellectual property rights. It looks at the nature and extent of that protection, ways in which to trade in intellectual property rights, and actions to take if those rights are infringed.
Knowing how to protect and trade in rights in intellectual property is important in a commercial world in which images, designs and characters are endlessly replicated and imitated. This book examines and explains the conditions necessary for the protection of identifiable intellectual property rights, the nature and extent of that protection, ways in which to trade in intellectual property rights by licensing and franchizing, and the range of actions and remedies available if those rights are infringed. Although the book predominantly deals with UK law, there is also reference to the law of other jurisdictions - notably the US, Europe and South East Asia which provides an international focus for practitioners.

Joanna Jeremiah is a barrister of Gray's Inn, London and an advocate and solicitor of the Supreme Court of Singapore and High Court of Malaya. She is also a former lecturer at the Faculty of Business Administration, National University of Singapore.

Merchandising rights as an extended action of passing-off; merchandising rights as a right of property in the mark, name or get-up (including fictional and non-fictional characters); rights in shapes, containers and other commonplace articles; use of well-known images and features in advertising; using trade marks and service marks to protect merchandising rights; using copyright and registered designs to protect merchandising rights; other sources of protection including defamation, injurious falsehood, invasion of privacy and criminal and regulatory protection; civil remedies including injunction, delivery up, damages, account of profits, discovery and Mareva injunctions.
