Trade secrets are of great and increasing importance to the U.S. economy, representing the vast majority of U.S. intellectual property. Corporations spend billions of dollars to protect their trade secrets, but with data breaches on the rise, the scenario of the ever-increasing threats to trade secret protection is bleaker than ever. Because of this, trade secret litigation is increasing at a phenomenal rate. As a result of the ever-increasing number of trade secret lawsuits, litigants have paid and juries have awarded hundreds of millions--even billions--of dollars.


This book is intended to help business executives and in-house counsel take control of and protect what may be their business's most valuable asset--its trade secrets. In addition to a broader, more academic look at trade secret law, the book also draws on current, real-life examples of trade secret nightmares and the litigation experience of its primary authors to provide practical advice to the business owner, small legal department or firm, and solo practitioner.

Joanna H. Kim is a partner at Akin Gump Strauss Hauer & Feld, LLP in its Los Angeles office. Joanna represents clients in a wide range of intellectual property and business litigation matters, including copyright, trademark and patent infringement; trade secrets misappropriation; unfair competition; and royalty, licensing, and other contractual and business disputes. Joanna is a former engineer in the environmental and aerospace industry, with a degree in chemical engineering from the University of California at Berkeley. Joanna graduated from Loyola Law School, where she was a member of the St. Thomas More Law Honor Society and was the chief note and comment editor of the Entertainment Law Journal. August 2012 Jeffrey K. Riffer is a partner in Elkins, Kalt, Weintraub, Reuben and Gartside, LLP, based in Los Angeles, California. Jeff is a business litigator and regularly handles trade secret lawsuits. He previously was the Chair, and later Co-Chair, of the ABA Litigation Section's Trade Secrets and Unfair Practices Subcommittee. Jeff received a B.S. degree in Accounting from Indiana University, passed the Certified Public Accountant examination, and received a J.D. degree from Indiana University School of Law, where he was Managing Editor of the Indiana Law Journal and a member of Order of the Coif. August 2012 Gregory S. Bombard is a trial attorney at Duane Morris LLP in Boston. Greg’s practice focuses on claims of trade secret misappropriation and related claims like restrictive covenants, nondisclosure and confidentiality agreements, and business torts. Greg is a cochair of the Boston Bar Association’s IP Litigation Committee and a frequent writer and presenter on the unique issues arising in trade secret litigation. Greg is a cum laude graduate of Boston College Law School and was Phi Beta Kappa at the University of Connecticut. Emily J. Friedman is a solo practitioner at the Law Office of Emily J. Friedman where she works as outside in-house counsel for startup and emerging growth stage corporations in Los Angeles. Emily practices corporate and intellectual property law. Emily received her undergraduate in law from Sheffield Hallam University in the United Kingdom, and received a masters in law from UCLA School of Law, where she was submissions editor for the Journal of Law and Technology. Emily is currently pursuing a masters in computing and information technology at the University of Pennsylvania.
