This revised edition reconsiders the tactics involved in using the Police Complaints Procedure following a number of recent decisions. Also detailed is the practice and procedure involved in bringing an action against police, witness statements, pleadings and new information dealing with the difficult problems of formulating questions for the jury in false imprisonment and malicious prosecution cases. The second section of the volume provides coverage of the traditional tort actions: assault, false imprisonment, trespass, interference with goods and malicious prosecution. The chapters on police powers of arrest and detection have been revised to relate to the Police and Criminal Evidence Act 1984 and recent case law on the nature of reasonable grounds for suspicion. In Part 3, there is an examination of the steps which may be taken against illegal surveillance and information gathering. Also discussed is a new application of torts including negligence and misfeasance in a public office. The text also considers the relevance of the European Convention on Human Rights.
