Taking a practical approach to the complex law on the renewal of business leases, this book acts as a guide to the Landlord and Tenant Act 1954 and focuses on those aspects of the law that affect landlords and tenants in that situation. Extracts from cases are included to clarify points of law.
This book focuses on the law as it affects landlords and tenants approaching the end of an existing commerical lease. It is not intended to deal with the relationship of landlord and tenant during the currency of a lease, but is a guide for solicitors and surveyors regarding the operation of the Landlord and Tenant Act 1954 in order to ensure that tenants fully protect their rights and landlords are able to maximize the potential of their property. The interpretation of any Act of Parliament is left to the courts who have evolved a body of case law to explain the principles and the working of the Act. Most textbooks give this case law in the form of a footnote to the text, but they seldom consider the detail of the case itself. This book differs from the standard approach by utilizing the cases themselves as examples, which are included within the body of the text. This approach should make the Act clearer to readers who have to understand and work with it, whether they be students of law, estate management or surveying, or professionals in day-to-day negotiations.
An additional feature of value to practitioners is the inclusion of appendices that set out the 1954 Act as amended together with specimen notices, counter-notices and other relevant forms.
