This practical guide provides an overview of waste management law in the EC and the UK, and examines such individual areas of waste control as rubbish clearance, waste recycling, the shipment of waste, licences for waste facilities, civil liabilities and the aftercare of closed waste sites.
The regime for the collection and safe disposal of waste under the Control of Pollution Act 1974 has been significantly reformed by the Environmental Protection Act 1990 and the accompanying regulations, introduced as a result of the UK's obligations under European Community Directives. These changes include the separation, within local authorities, of collection and regulatory functions; the imposition of a new duty of care on those who produce, import, store, treat, transport, recycle or dispose of controlled waste; the monitoring of closed landfill sites and remedy gas contamination; new provisions as to the furnishing of information for public registers; and increased powers of discrimination in the award of waste management licences - the introduction of the concept "fit and proper person". This is a practical guide to the mechanisms for the control of waste management.
