Habeas corpus is the principal means under the common law for the protection of personal liberty. Dr Sharpe examines the nature of judicial review exercised on habeas corpus and explores the past, present and potential uses of the writ, primarily in English law.

Dr Sharpe examines the nature of judicial review exercised on habeas corpus and explores the past, present and potential uses of the writ. The first part provides an historical introduction, briefly tracing the development of the writ from its origins to the 17th century when it took its modern form. The next five chapters all deal with various aspects of the nature of review which is available on habeas corpus. They aim to rationalize and to explain the various historical, constitutional and sometimes accidental factors which deal with more technical and procedural considerations peculiar to habeas corpus. While the book focuses on the law of England, there are extensive references to Australian, Canadian and New Zealand authorities.

Part 1 Historical aspects of habeas corpus: medieval period; habeas corpus and the jutisdictional conflicts; habeas corpus and executive committals; procedutal defects and the habeas corpus act 1679. Part 2 Scope of review: the form of review on habeas corpus; juriscidtional review; review of patent error; superior court orders and convictions; certiorari-in-aid of habeas corpus; privative clauses; trivial defects non-discretionaty nature of habeas corpus; alternative remedies. Part 3 Consideration of questions of fact: rule against controverting the return; jurisdictional facts; procedural problems and issues of fact; review of sufficiency of evidence; burden of proof. Part 4 Habeas corpus and the executive: emergency powers - testing the legality of the power to detain; review of the exercise of the power to detain; executive detention orders in peace-time; a note on crown privilege. Part 5 Habeas corpus in criminal law: review of pre-trial proceeding and bail; habeas corpus and delay in trial; review of convictions; review of sentence; habeas corpus to challenge the validity of conditions of imprisonment. Part 6 Review of commitments for compulsory treatment; problems of restraint and time; territorial ambit of habeas corpus; appeals, successive applications and re-arrest; aspects of practice.
